These Terms of Service govern your use of the PropSight website, mobile applications, and related services. Please read them carefully — by using PropSight, you're agreeing to everything below.
01Agreement to these Terms
These Terms of Service (the "Terms") are a binding agreement between you and PropSight ("PropSight," "we," "us," or "our") covering your access to and use of the PropSight website, the PropSight mobile application, and any related content, features, or services we offer (together, the "Service").
By creating an account, purchasing a subscription, or simply using any part of the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
02What PropSight Is (and Isn't)
PropSight is a sports research and analytics platform. We aggregate publicly available sports data — such as player statistics, matchup information, odds published by third-party sportsbooks, and contextual signals like weather — and present analysis, projections, and research tools built on that data.
PropSight is not a sportsbook. To be completely clear:
- We do not accept, place, broker, or facilitate wagers of any kind.
- No money can be bet, deposited, staked, won, or lost through the Service.
- We are not a gambling operator, and nothing in the Service constitutes an offer to gamble.
- References to third-party sportsbooks are informational; we display data about those platforms but do not transmit bets to them.
Whether and how you choose to use any information from the Service is entirely your decision and your responsibility.
03Eligibility & Local Laws
You must be at least 17 years old (or older where your jurisdiction requires a higher minimum age for content of this nature) to use the Service.
Laws about sports wagering and related activities vary widely by country, state, and region. You are solely responsible for knowing and complying with the laws that apply to you. If using a sports analytics service — or acting on the information it provides — is restricted or prohibited where you live, you may not use PropSight. We make no representation that the Service is appropriate or lawful in any particular location.
04Your Account
Some features require an account. You can register using Sign in with Apple or an email address. When you create an account, you agree to:
- Provide information that is accurate and keep it up to date.
- Keep your login credentials confidential and not share your account with others.
- Notify us promptly at the address in Section 16 if you suspect unauthorized use of your account.
You are responsible for all activity that occurs under your account. We may refuse, suspend, or reclaim usernames that violate these Terms or infringe someone else's rights.
05Subscriptions & Billing
Plans and pricing
Parts of the Service may require a paid subscription. Current pricing is shown at the point of purchase. Prices may change over time; changes apply to future billing periods, never retroactively, and we will provide notice before a price change takes effect on your plan.
Free trials
We may offer free trials. Unless you cancel before the trial ends, your trial converts automatically into a paid subscription and the payment method on file is charged. Trial length and terms are disclosed when you start the trial. We may limit trials to one per person.
Automatic renewal
Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on your plan) until cancelled.
Cancellation
You can cancel at any time. Purchases made through the Apple App Store or Google Play must be cancelled through your App Store or Google Play subscription settings; purchases made on our website can be cancelled through your account settings. Cancellation stops future renewals — you keep access until the end of the period you've already paid for.
Refunds
Purchases made through the App Store or Google Play are subject to Apple's or Google's refund policies, and refund requests for those purchases must be made directly with Apple or Google. For purchases made directly from us, fees are non-refundable except where required by law, though you can always contact us and we will review requests in good faith.
06Acceptable Use
When using the Service, you agree that you will not:
- Scrape, harvest, or bulk-download data from the Service, whether manually or with automated tools, bots, or crawlers.
- Resell, redistribute, sublicense, or commercially exploit the Service's data, projections, or content without our written permission.
- Reverse engineer, decompile, or attempt to extract the source code, models, or methodologies behind the Service.
- Circumvent authentication, rate limits, paywalls, or other technical protections.
- Interfere with the Service's operation, including by overloading infrastructure or introducing malicious code.
- Use the Service to violate any law or the rights of any third party.
- Misrepresent PropSight output as guaranteed outcomes when sharing it with others.
We may investigate violations and take any action we consider appropriate, including suspension or termination under Section 13.
07Intellectual Property
The Service — including its software, design, text, graphics, logos, models, projections, confidence scores, and the selection and arrangement of its content — is owned by PropSight or its licensors and is protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial research. This license does not transfer any ownership to you and ends when your access to the Service ends.
Third-party names, logos, and marks that appear in the Service (including sportsbook brands) belong to their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without obligation to you.
08Informational Purposes Only
Everything PropSight produces — projections, confidence scores, expected value figures, trends, hit rates, and any other analysis — is informational and educational only.
- Sports are inherently unpredictable. No projection guarantees any outcome.
- Historical performance, including any hit rates we display, does not predict future results.
- Nothing in the Service is financial, investment, legal, or professional advice of any kind.
- Third-party data we rely on (odds, statistics, weather, injury reports) may contain errors or become outdated without notice.
Any decisions you make based on information from the Service are yours alone. If you choose to wager with a licensed sportsbook, never risk more than you can afford to lose. If gambling stops being fun, help is available — in the U.S., call or text the National Problem Gambling Helpline at 1-800-GAMBLER.
09Third-Party Services
The Service displays data sourced from third parties and may contain links to third-party websites or apps, including sportsbooks. We do not control and are not responsible for third-party content, accuracy, availability, policies, or practices. Your dealings with any third party — including any wagering you choose to do on a sportsbook — are solely between you and that third party.
10Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DATA WILL BE ACCURATE, COMPLETE, OR CURRENT; OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPSIGHT AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST WAGERS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FOR THE AVOIDANCE OF DOUBT, PROPSIGHT HAS NO LIABILITY FOR ANY WAGERING LOSSES YOU INCUR WITH ANY THIRD PARTY, REGARDLESS OF WHETHER YOUR DECISIONS WERE INFORMED BY THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12Indemnification
You agree to defend, indemnify, and hold harmless PropSight and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
13Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or where required by law.
On termination, your license to use the Service ends immediately. Sections that by their nature should survive (including Sections 7, 8, 10, 11, 12, and 15) survive termination.
14Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and take reasonable steps to notify you — for example, through the app or by email. Your continued use of the Service after changes take effect means you accept the revised Terms. If you don't agree with a change, stop using the Service.
15Governing Law
These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to personal jurisdiction there. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
